It is that time of the year again when you have to submit your Employment Equity report with the Department of Labour if you qualify as a Designated Employer.
Section 21 of the Employment Equity Amendment Bill Act 47 of 2013 states that all designated employers must submit their employment equity reports annually on the 1st working day of October (for manual submissions) or the prescribed date (for electronic submission) which usually closes in January (15 January 2020). All submissions must be done electronically on www.labour.gov.za.
Fines will be imposed for:
- Failure to submit a report;
- Failure to provide written notice in the event that you are not able to submit the report;
- If your reasons for non-submission are false or invalid
If a designated employer is not in possession of an Employment Equity Report, NO POINTS can be claimed for Black Economic Empowerment purposes (Management & Control element).
What is a Designated Employer?
A designated employer means:
- A person who employs 50 or more employees; or
- A person who employs fewer than 50 employees but has a total annual turnover that is greater or equal to the specific industry limit:

It is also important to note that together with the submission of the EEA2, the EEA4 also needs to be submitted. Please keep in mind there have been amendments to the EEA4 regarding the income differentials between the highest and lowest earner.
