SEESA Did You Know? POPI to Commence on 1 July 2020.

POPI is knocking on each organisations door, and with the recent breaking news, POPI will soon be entering. The POPI Act gives effect to section 14 of the Constitution which grants a person the right to privacy. The President has proclaimed that 1 July 2020 will be the commencement date on which further sections of the POPI Act will come into effect.

These sections set out the bulk of the POPI Act and organisations (both private and public) will be granted a one-year grace period after which they will have to comply with the requirements of the POPI Act. Organisations, however, should not sit back and relax, as 12 months will pass quickly and there is a lot to be done in terms of POPI Act compliance. Organisations who haven’t already, should be starting their journey towards POPI compliance as the Act amongst other things, regulates and sets out the conditions for the lawful processing of personal information and makes provision for procedures to deal with complaints.

Non-compliance with the POPI Act could lead to a fine of up to R10 million, imprisonment or reputational damage. As soon as the POPI Act has commenced, data subjects now more than ever, will be protected from the mismanagement of their personal information.
