FAQ – Will an observation test suffice if we don’t have a breathalyser?

An observation test can be conducted instead of utilising a breathalyser test device to determine whether the employee is under the influence of intoxicating liquor.
Instead of using a breathalyser test device to determine whether the employee is under the influence of intoxicating liquor, the employer can also use the Observation test. This is most useful when the employer notices unusual and unfamiliar behaviour by the employee (through observations) when reporting for duty as well as when an employee refuses to blow into the breathalyser device.

The observation test contains a shortlist of questions to be completed based on the observations by the person conducting the test together with a witness. Questions include the following but are not limited to: Does the employee’s breath smells of alcohol, do his eyes appear to be bloodshot, does he appear to be aggressive, any difficulties or obvious changes in speech, etc.

After completing such a test with a witness, the test results are then admissible at the disciplinary hearing and must be corroborated by the person who conducted the test and the witness present during the test.
