FAQ – Can Political Parties Interfere In The Workplace?

No. It has become a trend that Political Parties enter the workplace sphere and try to involve themselves in work-related matters between employers and their employees.

In terms of the Labour Relations Act, 1995, the workplace is more commonly an area for Trade Unions, Employers Organisations and/or Workplace Forums.

In two recent Labour Court Cases, the court confirmed that political parties have no place in involving themselves in work-related matters.

In Calgan Lounge (Pty) Ltd and others v EFF and others J2648/18 (LC), the employer approached the court to interdict employees from participating in an unprotected strike and also sought to interdict the EFF and its members from interfering in the employment relationship. The EFF involved themselves in disputes the employees had and also instigated unlawful strikes and protest action.

The court granted the relief, stating that the EFF has no business involving themselves in work-related matters and that there is no place for the involvement of political parties in the employment relationship.

In Brightstone Trading 3 CC t/a Gordon Road Spar v EFF J605/21 (LC), the EFF was also interdicted from interfering in the workplace. They were prohibited from various acts, including blocking access, disrupting or unlawful interference with the business, intimidating, harassing or threatening conduct, inciting or instigating unlawful conduct, unlawful interfering with the employment relationship and protesting (other than in accordance with relevant legislation).
